A contingency agreement with an insurance claim contractor in Minnesota is a contract that depends on the insurer approving the claim. Minnesota Statutes section 326B.811 gives a homeowner a right to cancel certain insurance-paid residential contracts within 72 hours after the insurer says the claim is denied. Read the current text or ask an attorney about your contract. JMB Builders does not ask you to sign before the adjuster decides. Twin Cities metro.

  • Contingent contract: work depends on approval
  • Minn. Stat. 326B.811: 72-hour cancel after denial
  • Read the current statute; no legal advice here

After a big storm, some contractors ask homeowners to sign before the adjuster has even come out. The paper is usually called a contingency agreement, an inspection agreement or an authorization: the work is contingent on the insurer approving the claim, and if it is approved the contractor gets the whole job at whatever the insurer pays. On a large claim, every window, the doors, maybe the siding and roof, that is a big commitment to make before anyone knows the scope.

Minnesota has a rule for this. Minnesota Statutes section 326B.811 gives the insured the right to cancel certain residential contracts paid from a property insurance claim within 72 hours after the insurer notifies them the claim is denied, by written notice to the contractor at the address in the contract, and requires the contractor to return payments except for emergency work already done. The statute was written for roofing contracts and amended since; whether it reaches a contract for windows alone is a question for the current text on the Minnesota Revisor's website, or an attorney. We are not your lawyer. The statute was written for roofing and siding contracts; whether it reaches a windows-only or doors-only contract is a question for your agent or an attorney.

The simpler answer is to wait. You do not need a contractor's signature to file a claim or to have the adjuster come out. Get the damage documented, have the adjuster inspect, read the estimate, then sign with the contractor whose line-item quote you trust. With JMB Builders you sign after the scope is known: we document every opening, meet the adjuster when you want us there, and quote by opening. Separately, Minnesota Statutes section 325E.66 bars a contractor from paying, waiving or rebating your deductible.

Situations and options

Contingency agreement

Signed before the adjuster. The contractor gets the job if the claim is approved. Read who sets the price and how you can cancel.

Inspection or authorization form

Sometimes worded as only letting a contractor talk to the insurer or inspect. Read it for any language that commits you to the job.

Assignment of benefits

Hands claim payments or rights to the contractor. A larger step than a contingency agreement; ask your agent before signing one.

Contract after the estimate

Signed once the insurer's scope is known, with a line-item quote by opening. How JMB works.

Contingency Agreement Insurance Claim Contractor in Minnesota: questions, answered

Can I cancel a contractor contract if my insurance claim is denied in Minnesota?

Minnesota Statutes section 326B.811 gives a homeowner the right to cancel certain insurance-paid residential contracts within 72 hours after the insurer notifies them the claim is denied, by written notice to the contractor. Which contracts it covers has changed over the years, so read the current text on the Revisor's website or ask an attorney about yours.

Should I sign with a contractor before the adjuster comes?

You do not have to. A claim can be filed and the adjuster can inspect without any contractor under contract. You can have a contractor document the damage and meet the adjuster first, then sign once you have seen the insurer's estimate and a line-item quote. JMB Builders works that way.

What is a contract contingent on insurance approval?

It is an agreement that only takes effect if the insurer approves the claim, and then usually gives that contractor the whole job at the insurer's price. It can be one page. Read who sets the scope, who sets the price, and how and when you can cancel before signing.

What are my storm contract cancellation rights in Minnesota?

Besides the 72-hour right after a denial under section 326B.811, other rules may apply depending on how and where the contract was signed. We do not give legal advice. Read the contract's cancellation section, check the current statutes, and ask an attorney or the Minnesota Department of Labor and Industry if you are unsure.

Is a contingency agreement the same as assignment of benefits?

No. A contingency agreement makes the job depend on approval. An assignment of benefits hands claim payments or rights to the contractor, which is a bigger step. Ask your agent before signing either, and read every page.

Does JMB Builders use contingency agreements?

We do not ask you to sign before the adjuster decides. We document every opening, meet the adjuster when you want us there, and give you a line-item quote by opening to sign when you are ready. Send photos for a reply within one business day, or book a free in-home estimate.
